Truck Kills Pedestrian in Deadly Crosswalk Accident in Manhattan

A deadly crosswalk accident in Manhattan has claimed the life of a 31-year-old woman months after she was struck by a large truck.

The woman was crossing the street in a marked crosswalk at the intersection of Ninth Avenue and W. 17th Street in Manhattan when the driver of a large 18-wheeler struck her. Initially, the victim was knocked to the ground by the front portion of the truck and then was crushed under the rear wheels of the vehicle.

The woman was rushed to a nearby hospital where her condition was stabilized. However, she suffered for nearly five months before succumbing to those injuries.

Safety advocates have questioned why the NYPD didn’t issue criminal charges or even a summons to the driver who was operating his vehicle off an approved truck route and who also may have been distracted.

Truck accidents in New York City involving pedestrian collisions often result in the victim being struck multiple times or crushed simply because the driver either doesn’t notice the initial impact or can’t stop the massive vehicle in time to avoid striking the pedestrian.

Under New York law, a pedestrian is able to obtain no-fault benefits from the insurance company of the vehicle which struck her for all health-related expenses. In addition, a pedestrian can bring a lawsuit for pain and suffering of the injuries sustained in the accident along with any lost wages. In this case, the woman’s family can sue for pain and suffering for time she survived after the accident, and if she was working, lost wages for the time she was out of work and the amount of money she would have contributed to her family over the course of her working life.
