$45 Million Lawsuit Stems from Missing Stop Sign Accident in Queens

A missing stop sign accident in Queens left a 1-year-old boy with brain damage. That’s what the infant’s mother is claiming in the $45 million lawsuit she filed against New York City last month. Oddeth Davidson claims she was riding in an Uber with her young son when that car was “T-Boned” by another vehicle that blew through an intersection in Queens.

An investigation into the cause of the accident uncovered a missing stop sign at the intersection. Now this distraught mother is blaming the City for her son’s injuries, stating that transportation workers had the legal obligation to replace the missing sign and that their failure to do so directly contributed to the crash.

The Queens car accident occurred just after 1PM on January 11th at the intersection of 225th Street and 120th Avenue in the Cambria Heights neighborhood. Neighbors living near the intersection came forward after the crash and stated they had made multiple complaints to the City’s 311 line concerning the stop sign (which had been missing for months). However, the sign was not replaced until a Department of Transportation crew arrived hours after the intersection accident in Queens. For its part, the City claimed that they could find no record of the missing sign ever having been reported.

If the evidence supports the mother’s claim, the City could indeed be financially liable for the victim’s injuries. The DOT does indeed have a obligation to fix signage issues that could contribute to a catastrophic car accident in New York City. However, the law also requires that the DOT must have been aware of the issue prior to the crash.
