Fatal Bicycle Accident in New York City Highlights Danger of "Right Cross" Accidents

Failure to yield the right of way to pedestrians and bicyclists is a leading cause of collisions in our city. A vast number of serious bicycle accidents in New York stem from drivers either not paying attention to cyclists or just turning without giving the cyclist the right of way. This kind of accident (referred to by cyclists as "right cross" collisions) was tragically demonstrated earlier this month when a man was struck and killed while crossing an entrance ramp to the Cross Bronx Expressway.

The bicyclist was killed when a box truck travelling in the same direction turned right without yielding to the rider. The victim was left gravely injured on the asphalt while the driver of the box truck simply drove away. Witnesses to the accident stopped to help but by the time rescue crews arrived on scene it was too late. He was declared dead at a local hospital.

A failure to yield accident is unfortunate but there is absolutely no excuse for leaving the scene of a fatal accident. However, it is unclear whether the driver even noticed that he had struck the bicyclist. Indeed, one of the most common responses to questioning when hit and run drivers are apprehended is "I didn't even see him." Nevertheless, it does not absolve the driver from responsibility.

All drivers have the obligation to watch for pedestrians and bicyclists which may in their path of travel and yield the right of way when necessary. As long as the driver is aware of a pedestrian or bicyclist, the driver has the obligation to do his best to avoid a bicycle accidents in New York City even if the pedestrian or bicyclist does not have the right of way.
