A young woman was killed earlier this month when she was struck by a van while riding her bicycle along 35th Street in the Astoria neighborhood of Queens. Reports from the scene of this deadly bicycle accident in New York City show that the victim was riding in a marked bike lane when she was struck by a large van around 11PM.

EMTs rushed to the scene and found the young woman seriously injured, suffering life-threatening leg and head trauma. She was rushed to nearby Elmhurst Hospital. However, her injuries were too severe. She was pronounced dead a short while later.

A police investigation into this deadly bicycle accident in Queens is ongoing and no charges have been filed against the driver-who stayed at the scene of the crash and is reportedly cooperating with police. The case may very well hinge on whether or not the stop light at the incident in question was red at the time of the crash. Investigators will no doubt be reviewing traffic cam footage to see if they can figure out whether the driver is at fault.

If found at fault-even partially at fault, for this tragic fatal bicycle accident in New York City -the driver could be held financially responsible for the victim’s pain and suffering for the period of time she survived after the accident and damages equaling the amount of money she would have contributed to her family household from her weekly earnings. In addition, NYC law does allow for a victim’s family members to seek financial compensation for unpaid medical expenses, funeral expenses, lost financial support, and pain and suffering in such fatal crashes.
