Landlord's Failure to Respond to Unsafe Elevator Conditions Results in Lawsuit

It's a landlord's responsibility to regularly inspect, maintain, and repair elevators in order to avoid potentially harmful elevator accidents in New York City. When landlords fail to do so, innocent tenants and guests are put at risk.

Tenants who call an Ebbets Field apartment building home say that their landlord has regularly failed to respond to complaints about shoddy and unsafe elevators in their building. The complaint states that only three out of the four elevators in the building were operational at the time the court filings were submitted and the other elevators regularly break down.

The New York City Department of Buildings visited the apartment in November, 2018. They found that two of the elevators were out of service. However, they could issue no citations nor record any violation because both elevators were listed as "under repair." Since then, more complaints have been filed.

Now a group of tenants is suing the landlord, stating that the elevators are unsafe. The purpose of the lawsuit is to force the landlord to complete necessary elevator repairs. More importantly, this lawsuit has put the property owner on notice of all the elevator problems. In the event of an accident, the injured party will have to prove that the owner knew or should have known about the problem and this lawsuit will prove conclusively exactly that.

Rarely do elevator accidents in New York City occur without warning. If complaints such as misleveling, doors closing too quickly and elevator cars dropping are not made and other maintenance deficiencies not reported, tenants are permitting their landlord to escape their financial responsibility if someone is injured in an elevator accident.

Proving liability against a landlord in an elevator case is not an easy task. It is a difficult and complex lawsuit. If you or a loved one has been injured by a defective or improperly maintained elevator, you need a skilled and experienced elevator accident attorney in New York City.
