Fatal Pedestrian Accident in Morningside Heights Leads to Arrest and Criminal Charges

The careless driver who caused a fatal pedestrian accident in New York City earlier this year is now in police custody. This all stems from a pedestrian accident in which a man was killed while crossing the street in Morningside Heights nearly three months ago. The NYPD has now arrested a 24-year-old man and charged him with multiple crimes.

In January, 75-year-old Peter Awn-a former Colombia University Professor-was killed while crossing the street just blocks from the campus. Awn was crossing in a marked crosswalk and had the right of way when he was struck by a Toyota Highlander. The driver stayed on scene but was not immediately charged. Awn succumbed to his injuries almost a month after being struck.

Now the NYPD have decided there is evidence enough to charge the 24-year-old man with multiple crimes in relation to this fatal pedestrian accident in New York City. The Queen's resident was arrested on March 20th and faces jail time for failure to yield and failure to exercise due care.

Both crimes are codified in New York's Vehicle Code which specifically gives pedestrians the right of way in crosswalks and mandate that drivers must always proceed with caution in the presence of pedestrians. If convicted, the driver could be facing up to 30 days behind bars and fines.

However, surviving family members could potentially hold the man financially liable for their loved one's death. Indeed, the law allows for such individuals to file lawsuits seeking financial compensation for losses associated with an untimely death including emotional pain and suffering for the time the pedestrian survived after accident until his death. The family can recoup in the lawsuit the amount of money Mr. Awn would have contributed to family during the course of his working lifetime.
