Subway Accident in New York City Leaves Worker Hospitalized

An MTA employee was seriously injured in a subway accident in New York City earlier this month. The man was working on tracks near Yankee Stadium on Friday September 6th around three in the morning when something went terribly wrong. EMTs were called to the scene and found the man suffering from severe burns. Somehow, the victim fell onto the electrified third rail that provides power to the subway trains that pass underneath the streets of NYC.

It's unclear as yet exactly how the accident occurred but with the third rail of the MTA subway lines carrying 625 volts of electricity, it's a miracle that the man survived. Indeed, earlier in the month another man of a similar age was killed when he accidentally came into contact with the third rail.

Media reports show that this latest victim of a horrific electrical subway accident in New York has been with the MTA for nearly 12 years with no prior accident s of this nature. He is expected to survive his injuries but electrical burns of a severe nature can leave victims with long-lasting, even lifelong aftereffects.

While the City does not have to guarantee the safety of everyone who might be exposed to third rail electrocution, it does have a responsibility to take reasonable steps. The City's responsibility includes reasonably eliminating the risk of electrical exposure and protecting workers and others from being electrocuted. A thorough investigation is under way. If the investigators conclude that the City of New York (the City actually owns the subways) failed in its duty to protect the worker, the City could be held liable (thus financially responsible) for the man's recovery-including medical expenses, lost wages, pain and suffering, and more.

If you've been injured while on the job working for the MTA, even an insurance settlement may not be compensation enough to cover your entire recovery.
