Bicycle Accident in Queens Leaves Family Reeling

On Behalf of | Nov 4, 2019 | Bicycle Accidents

A 65-year-old man was killed in a fatal bicycle accident in Queens earlier this month along a dangerous stretch of the Cross Bay Boulevard. The man was riding his bike north near Fourth Street when he was struck by an SUV. The collision was loud enough that people inside nearby homes came to see what had happened. When rescue crews and accident investigators arrived at the scene of the crash, they found the man unconscious and unresponsive. By the time he arrived at a nearby hospital, he had succumbed to his injuries.

Residents of the area say that this stretch of street is particularly dangerous with motorists treating it like a “racetrack.” There have been multiple accidents in the same general area in the recent past and despite complaints, nothing has been done to make the roadway any safer for motorists, bicyclists, or pedestrians. According to one individual, it was “just a matter of time” before somebody was killed.

Police suspect no criminality in this tragic fatal bicycle accident in Queens. That means that the driver of the SUV (who stayed at the scene after the accident) will not likely face any criminal charges. However, it doesn’t mean that the driver and owner of the vehicle are completely off the hook. In similar bicycle accidents in New York City, the surviving family members and dependents of the deceased victims have been able to successfully sue for damages. These compensatory damages include:

  • Unpaid hospital, medical and funeral expenses (deceased victim is entitled for no-fault benefits from the insurance company for the automobile which struck the victim which should cover most of these costs)
  • Pain and suffering for time that the victim survived after the accident
  • The amount of money the victim would have contributed to his household over his lifetime
