One Killed One Injured in Construction Accident in Manhattan

One worker was killed and another seriously injured in a construction accident in Manhattan late last month. The two men work on a jobsite located at 1227 Broadway when something went terribly wrong. Accident reports state that the victims were riding a construction elevator up at the site when one of the men was struck by a piece of metal that protruded into the elevator shaft. The individual was crushed and then tumbled out of the elevator. It’s unclear how the second victim was injured.

FDNY responders arrived at the construction accident in Manhattan just after 3PM on Friday October 25th and attempted to resuscitate the victim but their efforts were in vain.

The Department of Buildings shut the jobsite down completely and initiated a full investigation into the events which led to this tragic fatality. The agency even called in specialized agents from the Elevator Safety division who are familiar with all the building codes and OSHA regulations placed on elevators and other mechanical lifts at jobsites around New York.

If the investigators conclude that the elevator was unsafe at the time of its use, the jobsite elevator contractor, general contractor in charge of construction project and property owner could be held financially liable for the happening of the accident. New York’s Labor Law specifically holds property owners and general contractors in charge of the construction project absolutely liable for a worker’s injuries in the event violations of the Labor law are found. The worker can sue for pain and suffering and lost wages for however long the worker can’t work. In the event of death, the family can sue for the amount of money the deceased worker would have contributed to the household over the course of his lifetime.
