Dozens of children were injured in a terrifying school bus accident in New York earlier this month. The high-school-aged children were travelling in two separate buses along the Palisades Interstate Parkway just north of New York City on the afternoon of October 15th when the two buses collided with each other, tossing students and chaperones about the interiors.
When the vehicles finally came to a stop, over 50 students had been injured.
EMTs arrived on scene at the New York school bus crash within minutes and assessed the injuries immediately. Most of the injured were transported to nearby hospitals for treatment and observation.
Head, neck, and soft tissue injuries are very common in New York school bus accidents like this. When a vehicle abruptly changes speed or direction (such as what happens when a bus is struck by another vehicle) the people inside are often tossed about. While these types of injuries may not appear to be as serious as lacerations and broken bones, they can result in concussions and brain injuries that take several days to manifest.
As parents, one of the scariest things we can do is place our children in the care of others. Teachers, chaperones, and bus drivers have a duty to keep our children reasonably safe from preventable accidents. When they fail to do that, they must be held accountable.
Under the law in New York City, all at fault vehicle owners and drivers including the owners, operators and drivers of a school bus can be held liable for a child injuries sustained in a motor vehicle accident. In addition, the child’s medical and health related expenses will be paid by the no-fault insurance company of bus the child occupied regardless of which vehicle was at fault for the accident.
