A New York highway accident claimed the lives of a Brooklyn man earlier this month. The two victims were in a box truck rolling down the highway toward Newark New Jersey when, for some unknown reason, the truck veered into the median. It swerved sideways, crashed into a guardrail, and overturned. The driver and two passengers were trapped inside.
When rescue crews arrived, they were able to pull one individual from the wreck alive. The driver and another passenger were killed instantly. One of the men was from Brooklyn. The second was from Georgia. It was not immediately clear what caused the accident.
In truck accidents in New York, specifically this tragedy, the driver will be held liable for the damages and injuries sustained by the passengers. Damages can include pain and suffering for injuries sustained, lost time from work and all out of pocket expenses including medical expenses and lost wages not paid by the insurance company for the truck (no-fault insurance). In addition, if the investigation reveals that another driver contributed to this accident, he or she may be liable to the injured parties caused by their careless or negligent behavior.
This case is a little different. Because the driver passed away in the crash, he will not be able to give any insight as to how this accident occurred. However, a good truck accident lawyer in New York will investigate and obtain the necessary police reports and statements from all eyewitnesses and will examine the actions of third parties-such as garages or mechanics to determine if faulty workmanship, or improper maintenance contributed to the crash. Only by conducting a thorough and complete investigation, can the injured parties be assured that they will recover the compensation they deserve.
