Apartment Accident in the Bronx Forces Evacuation

A shocking apartment accident in the Bronx has forced the evacuation of 49 residential units in a complex in the Claremont neighborhood along Findlay Avenue. Late on the evening of Monday, November 26th a massive section of retaining wall-estimated to be up to 20 feet wide and 18 feet high-collapsed, compromising the support of structure of the building directly in front of the retaining wall. The building was evacuated quickly as first responders warned that the collapse could have undermined the structural stability of the apartment building.

Upon further investigation, crews evacuated residents not only in that building but in the five surrounding buildings. All the three-story structures were emptied while crews determined whether or not they were safe to inhabit.

Thankfully nobody was injured when the massive retaining wall collapsed but the apartment accident in the Bronx left 25 people temporarily displaced.

FDNY first responders secured the scene immediately after the accident and the Department of Buildings was called in to try and uncover a reason for the collapse.

The residents of the apartment complex could hold responsible parties financially liable for any damages they suffered because of the collapse-including the cost of emergency housing and loss of any property. However, in order to recover the tenants would have to prove that neglect of an unsafe condition or a failure to inspect contributed to the collapse.

For instance, if sub-standard construction of the wall or a failure to repair or maintain or a failure to inspect the wall contributed to the apartment accident, the construction company, property owner and maintenance company could be held responsible to pay for all losses incurred by the tenants
