Fatal Bicycle Accident In New York City Makes Fourth Such in South Brooklyn This Year

A deadly bicycle accident in Brooklyn claimed the life of a 29-year old man early last month. Reports from the scene of the crash indicate that the bicyclist was crossing Avenue U near East 33rd Street in Marine Park at around 8 PM on May 13th when he was struck by a Toyota SUV being driven by a 20-year old. When EMTs arrived, they found the victim lying in the roadway with severe head trauma. The victim was rushed to nearby New York Community Hospital but his injuries were too severe. He was pronounced dead on arrival.

The driver remained at the scene as NYPD investigators recreated this fatal bicycle accident in Brooklyn to determine if criminal charges should be filed. The driver was not arrested at the scene.

This fatal bicycle accident in New York is the city's 8th such crash this year-the fourth in Brooklyn alone. This sets a frightening pace that will likely see the number of bicycle fatalities in New York top last year's figures-which set a record low.

While it appears the driver may be at fault for this latest fatality, safety advocates say that the city has not done enough to protect bicyclists in South Brooklyn. However, regardless of criminal action or DOT response, the victim's family members do have the right to pursue legal action against the driver and owner of the car. Damages would include pain and suffering for the time the victim survived after the accident, funeral expenses and most importantly, the amount of money the victim would have contributed over his lifetime to support the members of his household. Also, under New York's no-fault law, the victim is entitled to benefits which would help pay for the medical and funeral expenses.
