A terrifying bicycle accident in New York City left a man in critical condition in an area hospital late last month. The victim was riding along a section of Broadway (near the intersection of West 70th Street) when he was struck by a taxi cab. The crash happened at roughly 9 AM on Saturday, February 24th. The NYPD and other EMSs crews were on the scene within minutes. The victim was stabilized at the site then transported to a nearby hospital.
The unidentified individual was listed in critical condition. The driver of the taxi which struck the victim stayed at the scene and reportedly cooperated with NYPD investigators. Details pertaining to the crash are unknown but anytime a motor vehicle strikes a bicyclist the outcome is tragic.
Nationwide crash statistics show than the driver of the automobile is more often at fault for collisions that the rider of the bicycle. This is partly because the law places a greater burden on drivers-who have a duty of care to be aware of and watch out for the safety of bicyclists-but also because drivers involved in crashes report they often fail to see cyclists before it’s too late.
While the media and-to some extent-police agencies have often tried to shift blame to “reckless” or “careless” cyclists, the data just doesn’t back up the myth of the crazy cyclists zipping through traffic at excessive speeds and taking unnecessary risks.
While the fault is often laid at the driver’s feet, proving fault after the fact can be difficult, especially when the victim is recovering from serious or life-threatening injuries. That’s why it’s important that victims or their family members speak with an experienced bicycle accident attorney in New York City as soon after the accident as possible. An experienced attorney can offer guidance, will explain the recovery process and will act as an advocate for the needs of the injured victim.
