Crosswalk Accident in Queens Turns Fatal

On Behalf of | Apr 2, 2021 | Pedestrian Accidents

A man has succumbed to his injuries days after being struck by a car in a crosswalk accident in Queens. The victim, a 55-year-old man, was crossing Queens Boulevard on March 12th near the intersection of 84th Drive at around 1:30 in the afternoon. A Hyundai Elantra traveling southbound on Queens Boulevard struck him while making a left turn. The victim rolled up over the bumper and hood and struck his head on the windshield of the vehicle before being tossed to the pavement.

Emergency workers found him to be suffering from severe head trauma and rushed him to a nearby Jamaican Hospital Medical Center. He was listed in critical condition and never improved. Two days later, he succumbed to his injuries.

While an investigation into this tragic crosswalk accident in New York City is still ongoing, it appears as if the man was not only in the vicinity of a painted crosswalk when EMTs arrived but also had the green light when he was struck.

Left-turn accidents are one of the most common types of pedestrian accidents in New York City. Drivers either fail to see or fail to yield the road to pedestrians when they’re making those left turns.

When a person is struck within a crosswalk and is crossing with the green light, the driver bears full responsibility for the accident. As a pedestrian, the victim is automatically entitled to no-fault benefits from the insurance company for the car that hit him which will pay for the medical and funeral expenses. In this case, the victim’s family can also bring a claim against the driver and owner of the Hyundai Elantra for pain and suffering for the time the victim survived after the accident along with the amount of money the victim would have contributed to his household during his work life expectancy.
