Motorcycle Accident in New York City Leaves Two Teenagers Seriously Injured

Two teenagers are lucky to be alive after a motorcycle accident in the Bronx last month. The victims were riding a dirt bike-style motorcycle on May 13th along Bruckner Avenue in the Hunts Point neighborhood at around 7:30 in the evening when the bike collided with an SUV at the intersection of Hunts Point Avenue.

Both of the bike’s riders were ejected from the vehicle and tossed onto the pavement. The bike itself caught fire and exploded. A quick-thinking eyewitness with a fire extinguisher rushed to the aid of the boys and pulled them to safety. One of the victims was left with serious burns on his arm and was transported to a local hospital in serious but stable condition. The other suffered head trauma and was taken to a nearby hospital where he was listed in serious condition but doctors were able to stabilize him.

Undoubtedly, both the driver of the SUV and motorcycle operator will claim that each had the right of way to enter the intersection and will seek compensatory damages against each other. The passenger on the motorcycle, on the other hand, will have a claim for personal injuries against both the owner and driver of the SUV and motorcycle because he or she played no part in causing this accident and was merely sitting on the motorcycle at the time of the accident. The driver of the SUV will be able to apply for no-fault benefits from the insurance company for the SUV which will pay for all health-related expenses and up to $2,000 a month for lost wages. Unfortunately, there is no no-fault insurance for motorcycles in New York, so both the operator and the passenger of the motorcycle will be on their own for the medical expenses.
