Elevator Accident in New York City Kills One, Injures Another

A terrifying elevator accident in the Bronx late last month claimed the life of one construction worker and left another with serious injuries. The victims were working at a site on Bruckner Boulevard on Wednesday, May 19th when the freight elevator they were riding in collapsed beneath their feet. The elevator fell several stories (from the top floor of the building to the first). One individual died at the scene. Another was rushed to nearby Lincoln Hospital by EMS workers with serious injuries.

The Department of Buildings immediately opened an investigation into this work-related elevator accident in New York City. It appears as if repair or construction work was being done on the elevator at the time the victims were attempting to load equipment into it at the top floor of the four-story job site.

If the elevator was out of service, workers should not have been able to enter it. Safety regulations clearly state that any malfunctioning elevator is to be considered a hazard and should be locked out of use. Additionally, barriers and/or signage should have been used to keep individuals out of the lift while the repair/installation work was underway.

An investigation is underway by the Department of Buildings, but it appears that safety protocols may have been breached at the construction site. If so, the surviving victim and the family members of the deceased victim could hold the contractor in charge of the job site and property owner liable for the accident.

It also appears that sections of the New York Labor Law were violated. These sections are designed to protect construction site workers and hold the general contractor and property owner absolutely liable in a height related accident. This would entitle the injured worker and deceased worker’s family to compensation for pain and suffering and lost wages.
