Two People Killed in Collision Involving Stalled Semi Truck

Two people were killed in a fatal truck accident in New York City late February when the car they were in crashed into a broken-down trailer truck. The collision happened on the Cross Bronx Expressway at around midnight on the evening of February 26th. The victims were traveling in a Mitsubishi Montero and may have been travelling at a high rate of speed when they collided with the flatbed trailer truck.

Two passengers in the back of the vehicle were taken to a nearby hospital with serious injuries.

Pictures from the gruesome accident show the top of the car sheered off with the vehicle still underneath the trailer.

It’s unclear whether or not the broken-down vehicle was properly marked. If the truck was blocking the roadway and operator of the truck failed to use emergency lighting, barriers, or other methods to warn oncoming drivers of the hazard in the roadway, that could expose the driver and owner of the tractor trailer to liability on their part.

When a large vehicle breaks down on the road because they can become a tremendous risk for other motorists on the roadways—especially highways and expressways where there are higher speeds involved. Without proper warning indicators, illumination or barriers, the broken down truck  can go unnoticed until it is too late.

Cases such as these are difficult and require a minimum level of experience and expertise.  Not only is knowledge of law required but equally as important is the expertise on how to prove a successful case.  An attorney must know how to preserve evidence; retain the right investigator to find witnesses who can provide an insight as to what really happened; retain an accident reconstruction expert to reconstruct the accident as well as have the legal expertise .
