The NYPD investigation into a bicycle accident in New York has concluded that the driver of a Roosevelt Island Operating Corporation “red bus” is to blame. The accident, which occurred on Roosevelt Island’s Main Street, left a 29-year old Swedish model, Anna Maria Mostrom, functionally brain dead. While doctor’s were hopeful, the injuries she has suffered we re likely irreversible.
At roughly 9 P.M. on October 8, Mostrom was riding her bicycle northbound on Main Street in Roosevelt Island. The “red bus” (southbound) was stopped at an intersection preparing to turn left. The bus driver failed to yield to the bicyclist and turned into the oncoming lane, striking the bicyclist and throwing her to the ground. When EMS workers arrived, Mostrom was unresponsive. She remained unconscious with no signs of brain activity. Family members removed life support one week after the crash.
Strangely enough, a summons wasn’t forthcoming for the driver of the bus even though there is a new law on the books in New York City to punish motorists involved in this type of accident. Section 19-190 effectively makes it a misdemeanor for motorists to strike pedestrians or cyclists who have the right of way.
Local residents were not surprised when they learned of the accident. According to a report on Streetsblog, Roosevelt Island residents are very aware of the danger the large “red bus” poses on the narrow streets of the cozy Roosevelt Island neighborhood. “Every day there are near-accidents. Some days there are actual accidents.” said one unnamed resident.
Regardless of whether criminal charges are filed, family members of Mostrom have a strong grounds for a civil lawsuit. Under New York law, the bus driver who was at fault for the accident along with the bus company could be held responsible for financial damages suffered by Mostrom and her family members.
